Review: Senate Bill 607 and House Bill 2042 “An Act Modifying the Definition of Rape, Qualified Seduction and Simple Seduction involving Minor Children” by Sen. Francis and Rep. Evelina Escudero
Sadyang nakakabahala ang inihahain ngayong batas ni Sen. Francis at Rep. Evelina Escudero na SB 607 and HB 2042 (An Act Modifying the Definition of Rape, Qualified Seduction and Simple Seduction involving Minor Children) sa 16th Congress.
Narito ang 4 bagay na pinaka-nakakabahala sa kanyang bill:
1. “Art. 266-A, Rape is committed by a MALE PERSON who shall have carnal knowledge of a FEMALE PERSON…”
Lalaki sa babae lang po talaga? Paano po ang Male to Male? Female to Male? FYI, may mga nararape ho na batang lalaki. Hindi sila kasali sa poprotektahan ng estado?
2. “No rape is committed if the male person who shall have carnal knowledge of a female person…is himself below 18 yrs old”
Ay ganun? May mga bata rin pong nangrarape. Bakit hindi po sila isubject sa diversion at intervention program? Hindi sila maaring ikulong, subalit kailangan pa rin ho nilang dumaan sa diversion program. Base sa RA 10630, a child below 15 is exempted from criminal responsibility, but it does not exempt them from civil liability.
3. “Art. 337, Qualified Seduction – The seduction of a FEMALE PERSON who is a VIRGIN (emphasis mine) over 16 years and under 18 years …”
We laud that it encapsulates children up until 16 years old. Subalit, may gender bias na naman po (female person). At talaga ho bang kailangan virgin lang? Ang hindi virgin, hahaayaan ng magang-rape?
4. “Art. 338, Simple Seduction – The seduction of a FEMALE PERSON who is single or a widow of GOOD REPUTATION (emphasis mine)…”
Good reputation lang po talaga? Paano ho ‘yan papatunayan objectively? Kapag patutot, dahil walang good reputation, hindi na pinoprotektahan ng batas? Kapag bakla at tomboy pwede nang irape?
If this is the kind of bill they drafted, I think they could count on losing our votes. You’re writing our lives (because this bill turned law are going to govern our lives), please have a broader perspective.
